Taylor, Tusler, Vorpagel and Vruwink. <br />Referred to Committee on Transportation, Veterans and Military Affairs.<br /><br />1An Act to repeal 340.01 (30) (b); to consolidate, renumber and amend 340.01 <br />2(30) (intro.) and (a); to amend 23.335 (1) (q), 70.111 (1), 194.01 (7), 340.01 (29m) <br />3(bm), 340.01 (35), 340.01 (74p) (c), 341.05 (23), 346.02 (4) (title) and 346.02 (4) <br />4(a); and to create 340.01 (15ph), 346.806, 347.02 (1) (em), 347.489 (3m) and <br />5349.18 (4) of the statutes; relating to: electric bicycles and providing a penalty.<br /><br />Analysis by the Legislative Reference Bureau<br />This bill regulates the operation of electric bicycles.<br />Under current law, a motor bicycle is “a bicycle to which a power unit [that is] <br />not an integral part of the vehicle has been added to permit the vehicle to travel at <br />a speed of not more than 30 miles per hour with a 150-pound rider on a dry, level, <br />hard surface with no wind and having a seat for the operator” or “a 2-wheeled or <br />3-wheeled vehicle that has fully operative pedals for propulsion by human power <br />and an electric motor of less than 750 watts and that is capable, when powered solely <br />by the motor, of a maximum speed of less than 20 miles per hour with a 170-pound <br />rider on a dry, level, hard surface with no wind.” In general, a motor bicycle is subject <br />to the same rules as other bicycles and an operator of a motor bicycle is subject to the <br />same rules and is afforded the same privileges as operators of other bicycles. An <br />operator of a motor bicycle, however, must posses a valid operator's license.<br />This bill eliminates the second type of motor bicycle and establishes a similar <br />definition for electric bicycle. Unlike an operator of a motor bicycle, however, an <br />operator of an electric bicycle is not required to hold an operator's license.<br />Under this bill, an electric bicycle is “a bicycle that is equipped with fully <br />operative pedals for propulsion by human power and an electric motor of less than <br />750 watts.” Electric bicycles are divided into three classes, as follows:<br />1. Class 1 electric bicycles provide assistance only when the rider is pedaling <br />and cease to provide assistance when the bicycle reaches the speed of 20 miles per <br />hour.<br />2. Class 2 electric bicycles may be powered solely by the motor and are not <br />capable of providing assistance when the bicycle reaches the speed of 20 miles per <br />hour.<br />3. Class 3 electric bicycles provide assistance only when the rider is pedaling <br />and cease to provide assistance when the bicycle reaches the speed of 28 miles per <br />hour.<br />In general, an electric bicycle is subject to the same rules as other bicycles and <br />an operator of an electric bicycle is subject to the same rules and is afforded the same <br />privileges as operators of other bicycles, with the following exceptions:<br />1. Persons under the age of 16 years may not operate a class 3 electric bicycle.<br />2. A manufacturer or distributor of an electric bicycle must affix a label <br />containing the classification number of the electric bicycle, the speed at which the <br />motor will cease to provide assistance or power, and the wattage of the motor <br />equipped to the electric bicycle.<br />3. Either the motor must cease to provide assistance or power when the brakes <br />are applied or the motor must cease to provide assistance or power when the rider <br />stops pedaling.<br />4. A person may not operate a class 3 electric bicycle unless the electric bicycle <br />is equipped with a speedometer.<br />5. The Department of Transportation or local authorities may prohibit the <br />operation of electric bicycles, with the power unit in operation, on designated <br />bikeways.<br />For further information see the state and local fiscal estimate, which will be <br />printed as an appendix to this bill.<br /><br />The people of the state of Wisconsin, represented in senate and assembly, do <br />enact as follows:<br />1Section 1 . 23.335 (1) (q) of the statutes is amended to read:<br />223.335 (1) (q) “Off-highway motorcycle" means a 2-wheeled motor vehicle that <br />3is straddled by the operator, that is equipped with handlebars, and that is designed <br />4for use off a highway, regardless of whether it is also designed for use on a highway. <br />5“Off-highway motorcycle” does not include an electric bicycle, as defined under s. <br />6340.01 (15ph).<br />1Section 2. 70.111 (1) of the statutes is amended to read:<br />270.111 (1) Jewelry, household furnishings, and apparel. Personal ornaments <br />3and jewelry, family portraits, private libraries, musical instruments other than <br />4pianos, radio equipment, household furniture, equipment and furnishings, apparel, <br />5motor bicycles, electric bicycles, bicycles, and firearms if such items are kept for <br />6personal use by the owner and pianos if they are located in a residence.<br />7Section 3. 194.01 (7) of the statutes is amended to read:<br />8194.01 (7) “Motor vehicle" means any automobile, truck, trailer, semitrailer, <br />9tractor, motor bus, or any self-propelled or motor driven vehicle, except a motorcycle, <br />10moped, motor bicycle, electric bicycle, electric personal assistive mobility device, <br />11personal delivery device, or vehicle operated on rails.<br />12Section 4. 340.01 (15ph) of the statutes is created to read:<br />13340.01 (15ph) “Electric bicycle” means a bicycle that is equipped with fully <br />14operative pedals for propulsion by human power and an electric motor of less than <br />15750 watts and that meets the requirements of any of the following classifications:<br />16(a) Class 1 electric bicycle is an electric bicycle equipped with a motor that <br />17provides assistance only when the rider is pedaling and that ceases to provide <br />18assistance when the bicycle reaches the speed of 20 miles per hour.<br />19(b) Class 2 electric bicycle is an electric bicycle that may be powered solely by <br />20the motor and is not capable of providing assistance when the bicycle reaches the <br />21speed of 20 miles per hour.<br />22(c) Class 3 electric bicycle is an electric bicycle equipped with a motor that <br />23provides assistance only when the rider is pedaling and that ceases to provide <br />24assistance when the bicycle reaches the speed of 28 miles per hour.<br />25Section 5. 340.01 (29m) (bm) of the statutes is amended to read:<br />1340.01 (29m) (bm) “Moped" does not include a motor bicycle or electric bicycle.<br />2Section 6. 340.01 (30) (intro.) and (a) of the statutes are consolidated, <br />3renumbered 340.01 (30) and amended to read:<br />4340.01 (30) “Motor bicycle" means any of the following: (a) A a bicycle to which <br />5a power unit that is not an integral part of the vehicle has been added to permit the <br />6vehicle to travel at a speed of not more than 30 miles per hour with a 150-pound rider <br />7on a dry, level, hard surface with no wind and having a seat for the operator. “Motor <br />8bicycle” does not include an electric bicycle.<br />9Section 7. 340.01 (30) (b) of the statutes is repealed.<br />10Section 8. 340.01 (35) of the statutes is amended to read:<br />11340.01 (35) “Motor vehicle" means a vehicle, including a combination of 2 or <br />12more vehicles or an articulated vehicle, which is self-propelled, except a vehicle <br />13operated exclusively on a rail. “Motor vehicle" includes, without limitation, a <br />14commercial motor vehicle or a vehicle which is propelled by electric power obtained <br />15from overhead trolley wires but not operated on rails. A snowmobile, an all-terrain <br />16vehicle, a utility terrain vehicle, and an electric personal assistive mobility device <br />17shall be considered motor vehicles only for purposes made specifically applicable by <br />18statute. “Motor vehicle” does not include an electric bicycle.<br />19Section 9. 340.01 (74p) (c) of the statutes is amended to read:<br />20340.01 (74p) (c) An operator of a moped, electric bicycle, or motor bicycle.<br />21Section 10. 341.05 (23) of the statutes is amended to read:<br />22341.05 (23) The vehicle is a motor bicycle, electric bicycle, or bicycle, except as <br />23provided in s. 349.18.<br />24Section 11. 346.02 (4) (title) of the statutes is amended to read:<br />1346.02 (4) (title) Applicability to persons riding bicycles, electric bicycles, <br />2and motor bicycles.<br />3Section 12. 346.02 (4) (a) of the statutes is amended to read:<br />4346.02 (4) (a) Subject to the special provisions applicable to bicycles, every <br />5person riding a bicycle upon a roadway or shoulder of a highway is granted all the <br />6rights and is subject to all the duties which that this chapter grants or applies to the <br />7operator of a vehicle, except those provisions which that by their express terms apply <br />8only to motor vehicles or which that by their very nature would have no application <br />9to bicycles. For purposes of this chapter, provisions which that apply to bicycles also <br />10apply to electric bicycles and motor bicycles, except as otherwise expressly provided.<br />11Section 13 . 346.806 of the statutes is created to read:<br />12346.806 Special rules applicable to electric bicycles. (1) Except as <br />13otherwise expressly provided, an electric bicycle and an operator of an electric bicycle <br />14shall be afforded all the same rights and privileges, and be subject to the same duties, <br />15provided in chs. 340 to 351 as a bicycle or an operator of a bicycle. An electric bicycle <br />16shall be considered a vehicle to the same extent as a bicycle.<br />17(2) A person operating an electric bicycle is not subject to the provisions under <br />18ch. 341, 342, 343, or 344 relating to financial responsibility, operator's licenses, <br />19registration, or certificates of title.<br />20(3) (a) A person may ride, with the power unit in operation, an electric bicycle <br />21upon a bikeway, as defined under s. 84.60 (1) (a), under the jurisdiction of the <br />22department of natural resources, subject to any restrictions specified in a rule <br />23promulgated by the department of natural resources under s. 349.18 (4) (b), or under <br />24the jurisdiction of a municipality or county, subject to any restrictions specified in an <br />25ordinance enacted under s. 349.18 (4) (a).<br />1(b) A person may ride, with the power unit in operation, an electric bicycle upon <br />2a bikeway, as defined under s. 84.60 (1) (a), under the jurisdiction of the department, <br />3subject to any restrictions specified in a rule promulgated by the department.<br />4(4) No person under the age of 16 years may operate a class 3 electric bicycle. <br />5A person under the age of 16 years may ride as a passenger on a class 3 electric bicycle <br />6that is designed to accommodate passengers.<br />7Section 14. 347.02 (1) (em) of the statutes is created to read:<br />8347.02 (1) (em) Electric bicycles.<br />9Section 15. 347.489 (3m) of the statutes is created to read:<br />10347.489 (3m) (a) 1. After January 1, 2018, a manufacturer or distributor of <br />11electric bicycles shall permanently affix to the electric bicycle a label containing all <br />12of the following information in Arial font of a minimum size of 9 point:<br />13a. The classification number of the electric bicycle.<br />14b. The speed at which the motor will cease to provide assistance or power.<br />15c. The wattage of the motor equipped to the electric bicycle.<br />162. to offer a huge calendar of free cyclocross practice opportunities this year. <br />

You have 2 options to choose from at each practice: a beginners clinic and an
intermediate/advanced practice. It’s your choice, or you could try both! All
practices are free and open to the public. All ages and abilities are welcome
(boys and girls); anyone old enough to ride a bike and take instruction fairly

What you need: Definitely, you will need a bicycle in good working order (a
mountain bike is fine but you’ll probably want to remove all of the water
bottle cages), a snug fitting helmet and a full water bottle. In addition, for
your own comfort (but not essential), you might want cycling shorts,
sunglasses, and cycling gloves. All riders must wear a helmet. Knobby tires are
highly recommended.<br />
<br />
Some parks do not have bathrooms or water. Please plan accordingly.<br />
<br />
In addition to the cycling skills you will learn, expect to make new friends,
get in really good shape, have a ton of fun and perhaps get so stoked about
cyclocross that you might want to race this fall as part of the Wisconsin CX
Series.<br />
<br />
Rain: if the weather looks questionable, or the ground is damp or wet, practice
may be cancelled or relocated to Badger Prairie Park. The latest weather
information will be posted on the relevant Facebook pages by noon the day of

With over 30 years under its “tires,” this annual movie-themed group ride attracts and unites young bucks and old dogs alike over a common love of bikes and beer.<br /><br /><br />The FTTM is a casual paced ride covering 15-25 miles over a 6-7 hour span. The route changes every year offering a unique Milwaukee experience over and over again. Not only does the route change, but it’s a surprise until the morning of. What is more exciting than that? A mystery ride with mystery stops! The only thing you know when you wake up that morning is you will have a blast touring Milwaukee with 500 of your closest friends. <br />Free Bikes for Kidz collects thousands of bikes from the Madison community and brings together over 600 volunteers to fix up the bikes and give them away to Madison kids. This year our goal is to give away 1,500 bikes next month!<br /><br /><br />Join us for an evening at the Free Bikes 4 Kidz Madison workshop to connect with members of the staff and board and learn about the impact we're making in the Madison area. Some of the kids and our community partners will join us too! Many roads were flooded and cars stranded. This morning on the way to work, my bullit cargo bike was able to power through most of the flooded areas and we even floated it like a boat in a deep section. <br />

In a recent article in outsideonline, Eben Weiss makes some points about why he chooses to violate traffic laws while riding a bicycle. He argues that personal safety whilst riding is more important that technically following the law. I would think that most people would agree with Weiss that when faced with violating a traffic law or getting injured or killed, everyone would choose safety.<br />

Weiss concludes that "If you want cyclists to follow the law, you've got to make it possible for them to do so without dying." "As it is, many streets are still inhospitable if not downright hostile to cyclists, so its crazy to expect us to follow the rules just for the sake of appearances. After all, nobody's going to put on their best clothes to go to a shit-show."<br />

Weiss's observtions are backed up by some scientific data. <a href="http://www.madisonbikeblog.com/2015/12/should-wisconsin-have-idaho-stop-law.html">In a 2010 study by Jason Meggs from UC Berkely School of Public Health,</a> Meggs concluded traffic safety and other policy goals are best served by relaxing stopping rules for people who ride bicycles and women cyclists in London are three times more likely to get killed by a truk because the women are less likely to disobey red lights. <br />

Weiss makes the following pragmatic arguments for safety over law abiding.<br />

"The simple fact is that in a car-centric environment there are many circumstances in which breaking the law on a bike is not only justified but necessary to ensure your survival. This is why I follow a framework far more sensible than any municipal traffic code."<br />

"Consider traffic lights. Bike-haters are fond of saying cyclists only treat red signals as suggestions. Frankly, I wouldn’t even go that far. When I’m on my bike, I regard traffic lights the same way a dog regards an alarm clock: it doesn’t mean shit to me personally, though I am quite invested in the behavior it inspires in those around me."<br />

"The only relevant information I glean from a traffic light is how drivers are going to react to it. For example, I know that when the light turns green, three or four more drivers are going to speed through the intersection in a failed attempt to beat the red, and I also know that everyone behind me is going to start honking and doing their best to overtake and potentially right-hook me. This is why, at certain intersections, if there’s a safe moment for me to slip through the red and get a head start before the dam bursts, you’re damn right I’m going to go for it."<br />

"Okay, I know what you’re thinking: “Typical entitled cyclist, thinks he’s above the law because he’s smarter than everyone else.” Um, yeah, no shit. Cyclists have been forced into the gutter by drivers for the past hundred years, so of course anyone who’s riding bikes in this country for any amount of time has been forced to devise his or her own framework in order to survive and thrive. If it makes you feel any better, rest assured it’s not so much a sense of intellectual elitism as it is a survivalist one. Cyclists simply know more about how the streets work than drivers do in the same way that subway rats are more attuned to the workings of the transit system than the typical straphanger."<br />

We also run several races and other group events during the year, and have informal group rides most weeknights in season. With one end of the trail located in Madison, a tunnel (considered to be the darkest trail tunnel in Wisconsin), and the distinction of being the only inter-state trail in Wisconsin, the Badger State Trail is becoming the most popular trail in the state. The trail is the old Illinois Central Railroad corridor. The Badger Trail connects to the Southwest Path, the Military Ridge State Trail and the Capitol City Trail in Madison. The trail is blacktopped from Madison to Purcell Road (North of Belleville). Because of a slight bend in the tunnel, you gaze into total darkness. We recommend that you bring a bright flashlight. This tunnel may not be the longest trail tunnel in Wisconsin, but is considered by many to be the darkest in Wisconsin. From the tunnel, the trail continues south to <a href="http://www.badger-trail.com/monticello.htm" style="color: #1e7ec8; margin: 0px; padding: 0px;" target="_blank">Monticello</a> where it crosses the <a href="http://www.badger-trail.com/sugar_river.htm" style="color: #1e7ec8; margin: 0px; padding: 0px;" target="_blank">Sugar River State Trail</a>. From Monticello the trail continues to <a href="http://www.badger-trail.com/monroe.htm" style="color: #1e7ec8; margin: 0px; padding: 0px;" target="_blank">Monroe</a> and then on into Illinois. With a twenty-five year history, WORS, ( The Wisconsin Off Road Series), is one of the longest running, largest and most recognized mountain bike racing series in the world. WORS has promoted and staged over 270 cross country mountain bike races. On average, WORS events attract over 600 entrants and equal or greater number of spectators. WORS events are oriented toward recreational mountain bikers and provide high value healthy outdoor experiences, entertainment and activity for them and their families. Through the years, WORS events have evolved from one-day races into weekend social events. Many racers arrive with their families on Saturday to pre-ride the course and to share the experience with friends they have made as a result of their participation in the series. Wisconsin Interscholastic Cycling Association (WIN) was founded in 2013. WIN laid the ground work for high school mountain biking in Wisconsin with an inaugural state championship race. The Wisconsin State Mountain Bike Championship, held in 2013, consisted of 4 different categories and the event was tagged a success with 60 participants and 6 teams.</div>

In late 2013, WIN became an affiliate NICA league and was renamed the Wisconsin High School Cycling League (WI League) with the first race season scheduled for fall of 2014.</div>

The WI League, serves all Wisconsin high school and middle school-aged students, and regardless of ability level, is committed to providing a positive co-ed cycling experience. Each WI League season will include summer clinics, a four-race series, wilderness first aid certification courses and a Spring Leaders’ Summit for training and certification of coaches.</div>

WI League is committed to ensuring students and coaches learn and practice safe riding practices. To ensure students are able to develop their skills and be placed in an appropriate level for their racing experience, the WI League offers middle school and high school aged teams.</div>

The MadCity Velo Club is based in the Madison, Wisconsin, area for cyclists who enjoy racing, training, and commuting. They participate primarily in the Wisport, WCA, and ABR series events. On rails-to-trails bike paths, city streets, and winding country roads, the bicycle seems ubiquitous in the Badger State. Yet there's a complex and fascinating history behind the popularity of biking in Wisconsin--one that until now has never been told in depth. Meticulously researched through periodicals and newspapers, “Wheel Fever” traces the story of Wisconsin's first "bicycling boom," from the velocipede craze of 1869 through the "<a href="http://wheelfeverbook.com/" style="color: #1e7ec8; margin: 0px; padding: 0px;">wheel fever</a>" of the 1890s. From the start it has been defined by a rich and often impassioned debate over who should be allowed to ride, where they could ride, and even what they could wear. Many early riders embraced the bicycle as a solution to the age-old problem of how to get from here to there quickly and easily. Yet for every supporter of the "poor man"s horse, there were others who wanted to keep the rights and privileges of riding to an elite set. Women, the working class, and people of color were often left behind as middle- and upper-class white men benefited from the "masculine" sport and all-male clubs and racing events began to shape the scene. Even as bikes became more affordable and accessible, a culture defined by inequality helped create bicycling in its own image. "<a href="http://wheelfeverbook.com/" style="color: #1e7ec8; margin: 0px; padding: 0px;">Wheel Fever</a>" is about the origins of bicycling in Wisconsin and why those origins still matter, but it is also about our continuing fascination with all things bicycle. From "boneshakers" to highwheels, standard models to racing bikes, tandems to tricycles, the book is lushly illustrated with never-before-seen images of early cycling and the people who rode them: bloomer girls, bicycle jockeys, young urbanites, and unionized workers. Common issues include where a person can ride the e-bike, speed limits, and their classification.<br />

In Wisconsin, the DNR allows electronic bicycle use on certain state trails including the 400, Ahnapee, Badger, Elroy-Sparta, Glacial Drumlin, Hank Aaron, La Crosse River, Military Ridge, and others listed in WI NR Code 51.73.<br />
<br />
Under WI DNR NR 45.05 (3) (em), e-bikes cannot exceed 15 miles per hour while the electric motor is engaged.<br />
<br />
There is also an exception that allows the DNR to prohibit ebikes on any trails posted by notice and to open other trails not currently listed.<br />

The level or anger that got her to call people she has not ever met "assholes," is not out of care for the children, but really due to a recent change that personally affects her. </b> It turns out that her neighborhood roads were recently put on a "road diet," and now it takes longer for her to get where she wants to go when she chooses to drive a motor vehicle:<br />

<b>2. Since she chooses to drive a motor vehicle, she has a hard time relating to people who choose to ride a bicycle.</b> This leads to victim blaming instead of focusing on the person who causes the harm. Alkon admits that people who choose to drive motor vehicles cannot be trusted to do so safely. Like the people who blamed 14 year old Emmit Till for getting murdered for saying to a white woman, "How about a date baby,", Alkon likes to focus on the victim of the harm and not the person who caused it:<br />

<i>"If you bike next to speeding traffic, you are trusting drivers to never be distracted or get a medical condition and pass out. Perhaps you didn't consider that. If you don't consider it now, & put children in that situation, how do you possibly justify that?"</i><br />

She even goes as far to suggest that since people choose to drive drunk and look at their phones that people who choose to ride bicycles should, "have lights to prevent tragedy." <br />

<i>"He's right. I drive as if I'm terrified of hurting people - which I am - but many at night have been drinking, don't have good vision to begin with, are looking at their phones. Cyclists riding at night should have lights to prevent tragedy." </i><br />

Instead of blaming victims, Alkon should focus on the people causing the harm. She pretends that people who ride bicycles with kids are unethical, and assholes, however, under her reasoning, anyone who walks on any sidewalk at any time with a kid is an unethical asshole. Under her reasoning, drivers cannot be trusted. Clearly a small curb does not keep a drunk or texting driver on the roadway. The driver could certainly hop a curb and kill someone walking or pushing their child in a stroller. So should we just give up and let the drunk texting drivers win like Alkon wants? No more walking ever. You can only walk to enter your motor vehicle that is in your garage. We'll need way more parking spaces maybe 100 stories high next to each building so everyone can step from their car into the workplace, store etc. and not use the sidewalks currently in place. <br />

<b><br />3. Alkon's main argument lacks factual support and is seriously flawed.</b> When pressed by people who choose to ride bicycles, Alkon repeatedly asserts the following argument:<br />
<i><br />"Same car, same speed, crashes into car carrying child or child on mom's bike. Which is more likely to end tragically? Sorry rational thought is hard for you vis a vis your cycling fundamentalism."</i><br />
Akron does not provide any evidence that a child strapped in a car seat in a car is better of than one on a bicycle. For example, something <a href="https://www.ncbi.nlm.nih.gov/pubmed/24439608">like this study from Pediatric Surgery 2014, that found the risk of a brain injury for a child is similar among properly restrained and improperly unrestrained infants involved in higher speed motor vehicle crashes.</a><br />
<br />
Imagine sitting in a chair in your yard. An NFL linebacker weighing 250 pounds sprints into you at a speed of about 20 mph and lays into your back. You go flying like a football player does in a football game when they get hit. Now imagine the same scenario, but instead, you are strapped to the chair and the chair is buried in concrete and will not move. Your brain, spine, heart, and other body parts will start moving forward after the first hit and then slam into the inside of your skull and body as the chair holds you in place. Which would you prefer?<br />
<br />
Alkon's argument that because in her opinion a child in a car is better off in a crash than a child on a bicycle fails to account for a comparison of the likelihood of adverse outcome in each situation. Example, what if the chance of getting rear ended on a bicycle is 100 times less than in a car. Is the person choosing to ride the bicycle with a child still an asshole? What if the person choosing to ride a bicycle chose to live close to their job and child's school so there is never any need to get on a freeway. Now, the person bicycling with a child guarantees that any crash will occur at city speeds vs highway speeds. Are they still an asshole that endangers their kid?<br />
<br />
Using Alkon's analogy/comparison above, any person who chooses to put a child on an airplane or commercial jet is an asshole endangering the kid. How can a parent put their child on an airplane knowing there is a risk of the plane falling from the sky and smashing into the ground. All the parent needs to do is drive the kid around in a car and it is 100% certain the kid will not fall from the sky into the ground and die. But what about when the parent wants to travel over seas? Simple says Alkon, you put the kid on a boat and then you are not an asshole subjecting your child to falling out of the sky and dying. But wait, what happens when the boat overturns and your baby who doesn't know how to swim dies? You are an asshole again who endangers a kid. Alkon says:<br />

I guess if we all listen to Alkon we just keep our kids in the U.S. until they are 18 years old because putting them on an airplane or boat is "unnecessarily exposing them to deadly risk." The funniest part of this whole diatribe is that she chooses to expose herself to the unnecessary risk of traffic crashes by choosing to live and work where she does. If she chose to live near where she works she would not have to drive and get worked up about her city choosing to try a road diet. In 2016, 36,461 people died in traffic crashes. She is unnecessarily exposing herself to this risk. If she doesn't use a car, she can avoid this risk. <br />

<b>4. You know a weak argument when someone comments on what someone else supposedly told them.</b><br />

What would the ER doc have to say about plane crashes with kids? Kid drownings in pools? Kids dying from cancer? Kids getting run over when the parent leaves them near the tire of an auto? Kids getting forgotten in a car when it is hot out? "Kids choking on peanut butter? Kids dying from water skiing, snow skiing, snowmobiling, ice fishing, hunting, crossing the street, dehydration, respiratory infections, dog attacks, stroke, heart problems, rabies, snake bites, shark attacks.....bee stings.......I would love to hear from the alleged ER doc and ask him/her to me story about a kid getting tragically hurt or killed that is NOT terrible.<br />
<br />
Alkon says she does not have kids. If she did, an she wasn't a hypocrite, I would expect that she would keep her kids inside a sealed building 24/7. Why? Because every year mosquitoes kill 725,000 people. Clearly any parent who lets their child outside of an enclosed bubble is an unnecessary risk taking unethical asshole. God forbid the parent who takes their kid(s) camping. Alkon probably would be in favor of locking those parents up.<br />

because the person telling the other to wear a helmet does not trust themselves to look wear they are going when operating heavy machinery on the roadway? Maybe knowing that someone else is wearing a helmet makes the person driving the motor vehicle feel safer to do things like drive while distracted, drive intoxicated, speed, not look where they are going, roll stop signs and otherwise fail to pay attention to the task of driving?<br />
<br />
Think about it, usually when someone yells out, "where's your helmet," it involves a person sharing the road with motor vehicles. You don't hear people yelling it out at skate parks, trampoline parks, inflatable parks, roller rinks, boxing matches, rugby games, off road mountain bike trails, or most importantly, to other drivers of motor vehicles. In 2013, 383,231 people who operated motor vehicles suffered traumatic brain injuries in the U.S. Over the road truck driving is consistently rated as one of the most deadly jobs in America. No one asks drivers of motor vehicles where their helmet is despite the risk of a traumatic brain injury whilst driving a car being much greater than when riding a bicycle due to things like moving at 70 mph. <a href="https://www.ncbi.nlm.nih.gov/pubmed/25664958">Concussions occur in one out of every 61 tow away crashes. </a> Seat belts don't always prevent brain injuries. <a href="https://www.ncbi.nlm.nih.gov/pubmed/24439608">Traumatic brain injury is similar among properly restrained and improperly restrained infants in higher speed mvcs</a><br />

Where else in life do you see adults telling other adults (whom they have never met) how to stay safe and healthy? Have you ever been grocery shopping and a stranger comes up and says, whoa, you really shouldn't purchase that alcohol or cigarettes because it is harmful to your health? Or maybe, hey stranger, I see you bought a box of doughnuts and you are already overweight, "where's your broccoli." Why do people feel more strongly about a stranger riding a bicycle without a helmet than they do about a stranger inhaling an extremely addictive cigarette which increases chance of dying from lung cancer by 30 times.<br />
<br />
Is it o.k. to tell adult strangers what to do or what not to do? Where do we draw the line? Should we tell strangers not to get the supersize? To stay out of the ice cream aisle? To stay out of the tavern? To not walk on icy roads? To drive under the speed limit unless perfect conditions? To always use condoms? How about, "hey buddy, where's your radon mitigation system?" Will the strangers listen?<br />
<br />
What about the number one group of people who could benefit from wearing a helmet, the elderly? When we see a person aged 70 or over should we yell, "Where's your helmet." Falls in the elderly age category are number one cause of TBI.<br />
<br />
<a href="https://www.ncbi.nlm.nih.gov/pubmed/19276745">Studies have found that obese passengers are more likely to suffer a more severe head trauma after a frontal collision in a motor vehicle. </a> Should we all start going around and yelling at adult strangers, "Hey, lose some weight, it could save your life?"<br />

The officer who did this claimed he cuffed her because, "you were throwing stuff at me. You handed the ID card to me like you wanted to use it as a weapon and throw it at me."<br />

The reason the officer stopped her was because a person called the police and noted there was a man and woman riding bicycles at looking at driveways.<br />
<br />
Because the officer had a video camera on him we get to see the truth of what actually happened.<br />
<br />
People who ride bikes have several options available to video tape their rides and interactions with others. My personal favorite is the fly 6 rear and fly 12 front cams. They continuously record and tape over so you don't need to delete video but you can save it when necessary. The fly 12 also allows gps map overlays and three foot dram lines.<br />
<br />
The saddest part of this story is that it was this woman's first ride to work and she made a comment that she may no longer want to ride her bicycle because of this officer's actions. I don't blame her. It is pretty scary to see an officer lie and say she threw things at him when she did not. Imagine if the there was no video and the woman had a prior record. The officer could make up whatever lies he wanted and most people would believe him because they would think since she has a prior record and since the story is coming from a police officer, the officer must be telling the truth and she must be lying. <br />

Maybe now that rolling stop signs is legal, less people will get enraged when they witness it whilst sitting behind the wheel of their car (probably distracted by their phone). On the other hand, it may just increase the jealousy some people experience when stuck in traffic and watching others <a href="http://www.madisonbikeblog.com/2016/09/yet-another-reason-not-to-tax-bicyclists.html">engage in an activity that saves them money and makes them health.</a> Time will tell. Let's hope Wisconsin passes a similar law soon. <br />

An interesting side note, <a href="http://www.madisonbikeblog.com/2013/08/wisconsin-bicyclists-who-fail-to-stop.html">people who fail to stop at stop signs while riding bicycles in Wisconsin are treated less harshly than those who do the same thing in motor vehicles. </a><br />
<br />
Another side note, people riding bikes facing a red signal in Wisconsin can proceed through after first waiting at least 45 seconds for the light to change. See Wis. Stat. 346.37 (1). <br />
<br />Delaware rolling stop law:<div>
<br />(c) A bicycle operator approaching a stop sign at an intersection with a roadway having 2 or fewer lanes for moving traffic shall reduce speed and, if required for safety, stop before entering the intersection. After slowing to a reasonable speed or stopping, the person shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time the person is moving across or within the intersection, except that a person, after slowing to a reasonable speed and yielding the right-of-way if required, may cautiously make a turn or proceed through the intersection without stopping.</div>

According to a 2017<a href="http://www.ghsa.org/sites/default/files/2017-08/2017BicyclistSafetyReport-FINAL.pdf"> Governors Council Study,</a> bicyclist fatalities are up 12.2% nationwide. The same study notes that since 2011, an average of 55 ADDITIONAL people on bicycles have died annually on U.S. roads. <br />

Wisconsin <a href="http://wisconsindot.gov/Pages/about-wisdot/newsroom/statistics/fatality.aspx">DOT data August 2017 </a>shows 3 people were killed so far this year while riding. Lat year 27 people who were walking or jogging were killed the entire year and this year in August we are already at 41. <br />

This year's Belleville bike race is Sat., Aug. 12. Again, we'll start in Sugar River Park, the site of the 2017 Belleville Community Picnic. This year we will trial a separate start for those registering for the 11-mile race/ride. We'll let the 21-mile participants go out first and then, 3 minutes later, will send out the rest.<br />

The funds raised from this race go to the Belleville Community Club, which sponsors high school senior scholarships and local youth organizations, raises funds for and participates in community improvement projects, and organizes the annual community picnic.<br />
<br />
<br />
As always, awards after the race will be at noon in Sugar River Park and will feature the usual fabulous array of gifts and donations (thanks to Mary & Dale Funseth for their efforts).<br />
